How does classifying most consensual sex as rape help rape victims? As a lawyer who has handled rape and sexual harassment cases, I have no idea, but this radical result is what some want to happen in California. In endorsing a bill in the California legislature that would require “affirmative consent” before sex can occur on campus, the editorial boards of the Sacramento and Fresno Bee, and the Daily Californian advocated that sex be treated as “sexual assault” unless the participants discuss it “out loud” before sex, and “demonstrate they obtained verbal ‘affirmative consent’ before engaging in sexual activity.” Full Article

And what will they do when they get a he said, she said case? Next thing is they will want everyone that is having sex to have a signed affidavit giving consent.
Ah yes, no one has to take responsibility anymore for giving mixed signals.
A verbal or written consent form will be required.
How I long for the good old days before you could sue and win millions for spilling hot coffee on you lap.
This is the epitome of stupid; the government and the lunatics that think this stuff up need to stop trying to regulate sex. They aren’t very good at it (because it’s impossible)to begin with. Just look at the “sex offender” laws; none of them work as intended and the only thing they do is create confusion and cause problems. This harebrained idea would be about as enforceable as a law that says birds cant crap on statues.
Participants would be prudent to document and record such discussions and remit them to their proper educational administrator for approval before commencing any sexual activities. This would insure both parties are compliant within the letter of the law. Applicants should refrain from using sexual vagaries such as “A Dirty Sanchez” or “A Rusty Trombone” without proper citations, glossaries, or stick figure scribbles to expedite the process.
What next? Sexting Etiquette 101
That is so f*****g stupid. ‘Nuff said.
I think it’s time for a signed sexual contract…oh wait, contracts aren’t really valid anymore are they?
You would have to do a drug and alcohol test to make sure the person is able to consent to sign the sex contract. Giving up sex with another person is the safest option for all men.
This is total Feminazi lunacy!!!!!
This bill is a joke! I would like to think that our legislators are smarter than this… However, previous evidence would show otherwise…
I have enough of this absurdity. Is this country really becoming a circus? So, if the person is ok with having sex today, but tomorrow they don’t, will the 2nd day be rape then? Do they have to give a consent each and every time? Pleeeeaaaase. Get real here. When will this end. Can’t they do something better with their time than wasting everyone’s time with these ideas that become more and more laughable. Who votes for these people? I thought we are supposed to be examples for our children. Is this what we want them to learn? Idioticy 101.
People will need a permit to have sex…..’lets see your papers’…’ok, but it doesn’t cover that strap-on’…..WHaT ?!!
Pretty soon You will have to have a priest & a judge witness the act with Your attorneys present just to make sure Oh & they charge a fee by the hour?
There was a reason why sodomy laws were unconstitutional in the first place.
1. Unenforceable
2. Seeking punishment to regulate sex.
3. Overly punitive.
This was overturned in 2003. And yet here is a pseudo sodomy law to regulate sex again. Next thing what will happen is that they will ask every detail, how the act is going to play out so they can regulate that to. Probably mostly criminalizing most of it anyways.
